JUDGES OF THE CIRCUIT COURT

The Circuit Judges who have held court in Fayette county have served in succession in the following order:  Allen Taylor, E. L. Duncan, George H. Lee, M. Dunbar, Edward B. Bailey, Evermont Ward, Daniel Polsy, George Loomis, J. W. Hoge,  H. L. Gillispie, H. A. Holt, Ira J, McGuinnis, A. N. Campbell, J. M. McWhorter, W. R. Bennett, W. L. Lee, Vernon C. Champe, and John Wesley Eary.

The West Virginia Legislature of 1919 redistricted the judicial circuits, putty Fayette and Nicholas counties into the Twelfth Circuit.  Court terms are now held in Fayette county beginning the first Tuesday in January, April and July, and the third Tuesday in September.

JUDGES OF THE CRIMINAL COURT

The history of Fayette county courts from 1891 to December 31, 1918, is a dual one.  Because of the rapid development and population of Fayette county and the fact that the circuit was large and the Judge overworked, the Legislature of of 1891 saw fit to establish the Fayette County Criminal Court, and thereafter for a period of 27 years the Circuit Court was relieved of the responsibility of criminal trials.

Those who served as Judge of the Criminal Court were as follows: H. W. Brazie, 1891-1897; L. G. Gaines, 1897-1899; James H. Dunbar, 1899-1901; E. G. Pierson, 1901-1902; W. R. Bennett, 1902-1904; Jacob R. Koontz, 1904-1905; J. W. Eary, 1905-1099; J. T. Simms, 1909-1913; and Ben D. Koontz, 1913-1918.

The Legislature of 1911 cut off Fayette county from the then judicial circuit, making it a circuit of one county.  The Legislature of 1917, deeming that two courts were no longer needed in Fayette County, abolished the Criminal Court on and after December 31, 1918.

COUNTY SURVEYORS

Previous to the Civil war the office of County Surveyor was held in succession by Francis Tyree, Samuel Tyree, and George Loomis.  Since 1872 the following have filled this office in the order named:  Thomas S. Robson, J. W. Shreve, Samuel Tyree, H. J. Tucker, Isaac J. Settle, Henry A. Gentry, Earl Y. McVey, Henry A, Gentry, and W. O. Walkup, who is county surveyor at the present time.

COUNTY SUPERINTENDENTS OF SCHOOLS

Prior to the Civil was the office of County Superintendent of Schools was filled by appointment of the county court.  The three men who served in this capacity during this time were Joseph W. Pryor, Beuhring H. Jones, and Thomas S. Robson.  Since the Civil war the following have filled this position: Warren T. Timberlake, 1865-67; J. S. Cassady, 1867-1873, H. E. Shumate, 1873-1875; W. T. SENATORS AND DELEGATES REPRESENTING FAYETTE
COUNTY IN THE GENERAL ASSEMBLY OF
VIRGINIA FROM 1831 TO 1863

In the session of the General Assembly which met at Richmond, Virginia, December 6, 1830, and adjourned April 19, 1831, and during which Fayette was made a county from parts of Kanawha, Logan, Nicholas and Greenbrier, the territory of which the county was formed was represented in the State Senate by Andrew Bierne of Monroe, who represented the senatorial district composed of the counties of Greenbrier, Monroe, Giles and Montgomery, and by William M'Comas of Logan, who represented the senatorial district composed of the counties of Kanawha, Logan, Nicholas, Mason and Cabell. These counties of which Fayette was formed were represented at this session by delegates as follows: Greenbrier by Henry Erskine, Kanawha by George W. Summers, Logan by Anthony Lawson, and Nicholas by Addison McLaughlin.

Fayette county was made a part of the senatorial district composed of the counties of Kanawha, Nicholas, Logan, Jackson, Mason, and Cabell. This district was represented in the State Senate by William McComas of Cabell, from 1831 to 1833; by Benjamin H. Smith of Kanawha, from 1833 to 1839; by Robert A. Thompson of Kanawha, from 1839 to 1846. The county of Wayne was added to this senatorial district in 1843, and Putnam county was also added in 1848. James H. Fry represented this district from 1846 to 1850. The county of Wyoming was added to the district in 1850. Evermont Ward of Logan, was senator from this district during the session of 1850 to 1851. As a result of the census of 1850 the state of Virginia was re-districted, and Fayette was placed with the counties of Pocahontas, Greenbrier, Raleigh, Nicholas and Braxton to form a new senatorial district, which was represented by Thomas Creigh of Greenbrier, from 1851 to 1857. The session of 1853 to 1854 was the last annual session. According to a change in the Constitution the sessions were thereafter held biennially beginning in odd-numbered years, the first biennial ses-

sion being held in 1855 to 1856. Clay county was added to this senatorial district in 1859, and a part of Webster county was attached in 1861. The district was represented by William Smith of Greenbrier, from 1857 to 1861; and by Joseph A. Alderson of Nicholas, from 1861 to 1864.

From 1776 to 1830, the representation in the House of Delegates of the General Assembly of Virginia was composed of to members from each county regardless of population or wealth. This was changed by the Constitution of 1829-30, the basis of representation thereunder being one of population. Thus it was that a number of counties which prior to 1830 had two members in the House of Delegates, thereafter had but one, while other groups of counties on account of lesser population were united into delegate districts with one delegate from each district.

Fayette and Nicholas counties formed one delegate district from 1831 to 1851. As a result of the census of 1850 a change was made and Fayette and Raleigh counties were united to form one district in 1851, same remaining unchanged until 1864.

Fayette was represented in the lower house of the General Assembly of Virginia from the formation of the county in 1831 until the formation of the state of West Virginia in 1863, as follows: John G. Stevenson from 1831 to 1834; Samuel Price, 1834-35; Hudson M. Dickinson was declared elected in 1835 and served from December 5th to December 30th 1835, at which time he was succeeded by Samuel Price who prevailed in his contest for the seat, and served the remainder of the session which adjourned on March 24, 1836; Hudson M. Dickinson was again elected in 1836 and retained the position until 1838; Oliver L. Waite served the next term from January 7th to April 10th, 1839; George Alderson served from 1839 to 1840; Addison McLaughlin from 1840 to 1842; Aaron Stockton from 1842 to 1843; Francis Tyree from 1843 to 1845; John McClung from 1845 to 1846; Hiram Hill from 1846 to 1848; Fielding McClung from 1848 to 1849; Hiram Hill from 181849 to 1850; Robert Dunlap from 1850 to 1851. The new delegate district of Fayette and Raleigh counties were represented by William Prince from 1852 1858; James Montgomery from 1859 to 1860; John J. Coleman from 1861 to 1862, and by Benjamin R. Linkous from 1863 to 1864.

   Under the provisions of the first Constitution of West Virginia, from 1863 to 1872, the Legislature met annually; State Senators were elected for a term of two years; and members of the House of Delegates for one year.

Under the present Constitution, 1872 to the present time, the Legislature meets biennially; State Senators are elected for a term of four years; and members of the House of Delegates for two years.

The meeting of the first General Assembly under the Restored Government of Virginia was held at Wheeling, beginning July 1st, 1861, and ending July 26th, ensuing. Fayette county was not represented at this session. Edward M. Ryan was elected as a delegate from Fayette county during the year 1861, but the Committee on Elections refused to seat him January 16, 1862. John R. McCutchen of Fayette, was elected as a senator to the General Assembly under the Reorganized Government of Virginia. He represented the counties of Fayette, Nicholas, Pocahontas, Raleigh, Braxton, Greenbrier and Clay. He qualified and took his seat January 6th, 1863.

Fayette county was represented in the First West Virginia Constitutional Convention which assembled at Wheeling, November 26, 1861, and adjourned February 18, 1862, by James S. Cassady of Fayetteville. He was succeeded by Rev. Edward W. Ryan who was admitted to a seat February 3rd, 1862.
