There is one deed in Jan. 9, 1844, Deed of 59 acres, District No. 7, on the headwaters of Mitchell's Creek between Benjamin Garrett (no wife is mentioned here), Thomas Burgess, and Mahaly Burgess of the one part and Thomas Burgess of the other part, all of the County of Overton and State of Tenn. , witnesseth, that in consideration of sixty dollars in hand paid, the receipt whereof is hereby acknowledged, have this day bargained and sold and doth by these presents bargain, sell, and convey, unto the said Burgess, his heirs and assigns their undivided part of a certain tract of land originally the property of Edward Burgess now deceased, lying in County of Overton on the head waters of Mitchel's Creek, joining the lands of Linzie Hunter containing fifty nine acres . . . . . . . ... . . . ........the said Garrett and the said Franky Burges and the said Mehala Burgess doth bind themselves, their heirs and assigns to warrant and defend the title to the said Thomas Burgess, his heirs and assigns forever in testimony, we have set our names and fixed our seals . . . . . . .Signed Benjamin, Franky Burgess (made a mark), Mahly Burgess (made a mark.)Deed Book P, p. 465-466 Does this look as though these three own the land and two of them are selling their share to my Thomas? If so, he would also be an heir. Since the Garrett wife is not named, is she dead? Deed Bk. P., p. 550-551 Amor Rich and others, deed 59 acres on the headwaters of Mitchell's Creek, Overton Co., Tn. to Andrew Burgess. This indenture made and executed the 19th day of October by and between Jonathan Cross and Elizabeth Cross, his wife, and Amor Rich and his wife Della Rich and Edward S. It is unclear whether these references pertain to one such illegitimate child's birth; or two or three. (Maralee) In the 1850 Census for Wake Co., NC on page 210b, line 10 is Susan Searles age 65 and what appear to be a Daughter, Frances age 30 and a son, Chesley age 24. Both of these "children" are the correct age to be the "bastard" children to be born to Susan Surles and Susanna Searles. |

" , Joseph G. age 1 " " Tenn ____________________________________________________________________ "History of Overton County Tennessee" states that - Andrew J. Burgess was born ca 1821/1823 in N. C. He was the son of Thomas Burgess (hasn't been proved). He married Susan Reed. She was born in N.C., also according to the census. Susan Reed was the daughter of Jesse and Mary Andrews Reed. In the Jesse E. Reed cemetery, at the head of Little Eagle Creek, in Overton County, there is a grave of A.W. Burgess born 1823 died 1875. The court record lists heirs of Andrew Burgess. The children of Andrew and Susan were: 1. Louique born ca 1848. 2. Andrew Shell married Mahala Holman. 3. Sarah Cordelia born 1858 married 1st Levi Brinkley Mainord married 2nd Mose Seber. Sarah Cordelia died Sept. 1940. She is buried in the Hunter Cove cemetery. 4. John M. born ca 1863. 4. Permelia Ed married 7 May 1818 - Noe. 6. Eliza born 4 Oct. 1849 married W.O. "Bill" Miller. Eliza died 22 Jan. 1929. They are buried in the Miller cemetery. He gave the land for this cemetery and it bears his name. 7. Jesse L. Burgess. Source: A.J.
